JUSTICE BIRENDRA KUMAR ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/307/302 of the Indian Penal Code and Section 27 of the Arms Act. Altogether 29 persons including the petitioner are named in the F.I.R. and alleged to have fired indiscriminately causing injury to several persons and death of Manejar Yadav. Submission of the petitioner is that co-accused Mritunjay Kumar @ Mritunjay Kumar Singh and others have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.28843 of 2016. Co-accused Vinay Kumar Singh and another have allowed bail by a different Bench of this Court in
Patna High Court Cr.Misc. No.2691 of 2017 (2) dt.06-03-2017 2/2 Cr. Misc. 39179 of 2016 and co-accused Babloo Kumar has been allowed bail by yet another coordinate Bench of this Court in Cr. Misc. No.54022 of 2016.
Learned counsel for the informant opposed the prayer on the ground that Babloo was granted bail because he suppressed the fact that his name does not appear in the protest petition whereas in the protest petition, enclosed in the counter affidavit, his name appeared at serial No.5.
Considering the entire facts and circumstances of the case, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur/Successor Court, in connection with Maner P.S. Case No.508 of 2015. (Birendra Kumar, J) Mkr./- U T
