The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,448,323,324,325,307,379 and 504 of the Indian Penal Code and section 27 of the Arms Act.

No.42592 of 2015 (3) dt.30-10-2015 2/3 It is alleged that 16 FIR named accused persons who are petitioners herein, made assault as a result Shiv Swarup Das and Santosh Puri received grievous injury though the assault was made to others also. It is also alleged that petitioner Ashok Kohar resorted to two rounds of firing.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general. The accusation has been levelled in the background of land dispute as the order of mutation with regard to the land in question has been made in favour of the petitioners. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. More over, no fire arm injury has been caused to anyone.

It is submitted by learned counsel for the informant that two persons received grievous injuries though it is not disputed that the accusation of assault is omnibus and general and the occurrence took place in the background of serious land dispute between the parties.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Kudra P.S. Case No. 210 of

Patna High Court Cr.Misc. No.42592 of 2015 (3) dt.30-10-2015 3/3 2015 pending in the court of learned JM Ist Class, Kaimur at Bhabua.

This application is disposed of with the aforesaid observation/direction.
