ANJANA MISHRA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Gopalganj Town P.S. Case No.102 of 2015 for allegedly having committed the offence under Sections 21, 22, 23 and 27 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the petitioner submits that from the possession of arrested persons, small quantity of smack was recovered and it is on their confessional statement that the present petitioner was roped in connection with the present case. Learned counsel further submits that the petitioner is an old lady and has a history of several ailments. It is further

Patna High Court Cr.Misc. No.41543 of 2015 (3) dt.01-12-2015 submitted that the accused persons, who were arrested, have already been extended the privilege of regular bail. Considering the aforementioned facts and circumstances and that the petitioner is an old lady, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No.102 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
