Heard learned counsel for the parties concerned.

The present petition has been filed for restoration of Civil Misc. No. 1216 of 2018, which has stood dismissed on account of non compliance of the peremptory order dated 17.10.2022.

Learned counsel for the petitioners submits that Civil Misc. No. 1216 of 2018 was dismissed due to non-compliance of the peremptory order but now, the peremptory order dated 17.10.2022 has been complied. 4.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and appropriate to restore the aforesaid Civil Misc. No. 1216 of 2018 to its original file, subject to verification by the office regarding compliance of the peremptory order dated 17.10.2022.

The present petition stands allowed.
