JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Pirbahore P.S. Case No. 218 of 2016 for the offences punishable under sections 147, 149, 341, 323, 307 and 367 of the I.P.C and section 66 (E) of the I.T. Act.
Allegedly, the petitioner and other FIR named accused persons abducted the informant from the shoe shop and brought at Bakarganj in the Biscuit factory where he was assaulted brutally by iron rod, lathi-danda and from there he was brought to Mainpura where also in the parking of apartment he was assaulted
Patna High Court Cr.Misc. No.50475 of 2016 (3) dt.12-01-2017 2/3 and there he became senseless, from there he was brought at Digha where also he was assaulted and again he was brought at Boring Road near Shanghai Hotel where he was assaulted by iron rod on his head and after thinking that he is now dead they threw the informant and from there after first aid he was brought at Samrat Hospital, Bhagwat Nagar.
Submission is of false implication and that the occurrence is of 17.05.2016, whereas, fardbeyan has been recorded on 22.05.2016, the petitioner runs meat shop where the informant and others had come in drunken state and have quarreled and treatment has not been done in the government hospital rather in private hospital, the informant and others have caused threats and the petitioner had been beaten by other accused in drunken state and the informant falsely implicated the petitioner, without any explanation the FIR has been lodged after much delay, there is general and omnibus allegation and as such the petitioner deserves sympathetic consideration as he is student of B.Com-1st Part and in the morning and evening he runs meat shop.
The learned A.P.P. seriously opposes prayer for prearrest bail by pointing out the allegations as alleged against the petitioner.
Patna High Court Cr.Misc. No.50475 of 2016 (3) dt.12-01-2017 3/3 In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, I am not inclined to allow pre-arrest bail to the petitioner and accordingly prayer for pre-arrest bail of the petitioner is hereby rejected in connection with the aforementioned case pending in the court of C.J.M. Patna.
