2. The petitioner has preferred this application for grant of regular bail in connection with Thali P.S. Case No. 294 of 2024 dated 22.12.2024 registered for the offences punishable u/ss 126, 115(2), 117(3), 118(2), 109, 61, 111, 303(2), 352, 351(3) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons holding sharp edged weapon, sword and pistol are alleged to have assaulted one Bharat Yadav and Kuldeep Yadav causing injuries to them.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.20794 of 2025(3) dt.09-05-2025 2/3 this case. It is further submitted that the petitioner and the informant are agnates and land dispute is going on between them. There is no specific allegation of assault against the petitioner rather the allegation is general and omnibus in nature. Learned counsel has further submitted that the petitioner was not identified at the place of occurrence. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 27.01.2025. The co-accused person has already been granted regular bail by this Court vide order dated 22.03.2025 passed in Cr. Misc. No. 14811 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the injured sustained injuries which are stated to be grievous in nature.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Thali P.S. Case No. 294
