JUSTICE BIRENDRA KUMAR ORAL ORDER 22-06-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/447/323/307/325/504/379/34 of the Indian Penal Code. According to F.I.R. petitioner Sintu Paswan @ Sintu Kumar Paswan is alleged to have caused injury at the head of the informant with Dabia. The doctor has found simple laceration on the head of informant Mahendra Paswan. Allegation against the petitioner Laxmi Paswan is of commission of injury with lathi causing fracture of hand.

Considering the fact that petitioner Sintu Paswan @

Patna High Court Cr.Misc. No.17219 of 2017 (3) dt.22-06-2017 2/2 Sintu Kumar Paswan has knowledge that his act might cause death, I am not inclined to enlarge the petitioner Sintu Paswan @ Sintu Kumar Paswan on anticipatory bail. Hence, his prayer for anticipatory bail is refused.

Let petitioner Laxmi Paswan, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul/Successor Court in connection with Supaul Police Station Case No.545 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
