JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-10-2018 The petitioner seeks regular bail in connection with Islampur P.S. Case No. 313 of 2016, registered for offences punishable under Sections 379 and 411 of the Indian Penal Code. Allegation is of recovery of one stolen motorcycle from the house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and the house from which the alleged recovery is made is a joint house. Further petitioner has no criminal antecedent and has been in judicial custody since 19.06.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is disposed of with direction to the court below to verify the criminal antecedent of the petitioner and if it is found

Patna High Court Cr.Misc. No.64476 of 2018 (2) dt.26-10-2018 that he has no criminal antecedent except the present case, he shall release the petitioner on bail to his own satisfaction on furnishing bail bonds of Rs. 25,000/- (Rs.
