====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 07-07-2020 Heard Mr. Devendra Prasad Singh, learned counsel for the petitioner and Mr. Mritunjay Kumar Nirala for the State through Video Conferencing.

In this case, the petitioner is seeking regular bail in connection with Warisaliganj P.S. Case No. 276 of 2019 registered for offence punishable under section 30 (a) of the of the Bihar Prohibition and Excise Act.

It has been alleged that 65 litres of liquor has been recovered from the house of one Rajendra Choudhary. Earlier the petitioner had moved before this Court in Cr. Misc. No. 6367 of 2020 and the Court, vide order dated 04.02.2020, rejected the same, but liberty had been given to renew his prayer for bail after five months. Already five months have crossed.

No.21018 of 2020(3) dt.07-07-2020 2/2 In such view of the matter, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 2nd A.D.J.-cum-Special Judge, Nawada in connection with Warisaliganj P.S. Case No. 276 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in future in the same offence, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail granted to the petitioner.
