A counter affidavit on behalf of the University has been filed.
Impugned in the present writ application is the action of the Principal-cum-Assistant Election Officer in rejecting the nomination papers filed by the petitioner to be nominated/elected as teachers' representative of the governing body of the college in question which has affiliation from the respondent Magadh University.
Patna High Court CWJC No.21149 of 2014 (4) dt.17-09-2015 2/2 In the counter affidavit, it has been stated that the tenure of the governing body for which election was held has already expired. Paragraph 6 of the counter affidavit reads thus:- "That the tenure of teacher nominee is only for one year which has already expired.
Now the election for Sessions 2015-16 has been conducted and notified as such the writ application became infructuous."
Having regard to the aforesaid, in my view, the writ application has lost its relevance. It is accordingly dismissed as having become infructuous.
