Petitioner, who is in custody, seeks bail in connection with Kanti P.S. Case No. 402 of 2018 registered for the offences punishable under Sections 395, 397 and 412 of the Indian Penal Code.

Informant has alleged that on 08.07.2018 in the night while she was sleeping with her husband and daughter at about 1:30 A.M. she saw that eight miscreants were standing in their house and thereafter his husband took out his licensee pistol but his pistol was snatched by the criminals and also her golden chain was snatched and thereafter they took away

Patna High Court Cr.Misc. No.69482 of 2018(2) dt.04-12-2018 2/2 ornaments and cash which were kept in the Almirah. The looted golden chain was recovered from the possession of the petitioner and as such she was made accused in this case. It has been submitted on behalf of the petitioner that she is innocent and has been implicated in this case only as she had filed a complaint case against the police. Petitioner has no criminal antecedent and she is in custody since 10.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Kanti P.S. Case No. 402 of 2018. (S. Kumar, J) Rajiv/ManojU T
