2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 325, 379, 307, 384, 504/34 of the Indian Penal Code.
3. As per prosecution case, the informant alleged that on 14.6.2022, the petitioner along with co-accused persons came and demanded ransom when her husband denied, they started assaulting by means of iron rod repeatedly and also snatched her ear-ring worth of Rs. 25,000/-..
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is general and omnibus allegation leveled against the petitioner. During course
Patna High Court CR. MISC. No.24845 of 2024(2) dt.04-04-2024 2/2 of investigation, no any consistent material has come against the petitioner nor any eye witness was present at the place of occurrence. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since21.1.2024. Moreover, similarly situated co-accused namely, Mithun has already been granted bail by this Court vide order 22.3.2023 passed in Cr. Misc. No. 68212 of 2022.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barbigha P.S. Case No. 258 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sheikhpura.
