The petitioner, namely, Anjay Kumar Mehta apprehends his arrest in Aurangabad (Town) P.S. Case No.197 of 2015 under section 414 I.P.C.

The learned counsel for the petitioner submitted that the petitioner is the owner of the truck which was seized by the informant only on suspicion that the theft coal is being transported by the truck. The learned counsel further submitted that in fact the coal was transported by the petitioner and the petitioner has got valid papers. The papers showing validity of the transport were submitted and after verification the I.O. found the papers to be

Patna High Court Cr.Misc. No.42198 of 2015 (2) dt.14-10-2015 valid. The driver has already been granted regular bail. On the other hand, learned A.P.P. objected the prayer for anticipatory bail.

Considering the fact that the papers submitted by the petitioner before the I.O. are found to be valid and that the petitioner is the owner of the truck I direct the petitioner named above to surrender before the court below within six weeks from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.5,000/- (rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Aurangabad (Town) P.S. Case No.197 of 2015.
