The petitioner apprehends his arrest in Majhaulia P.S. case No. 24 of 2019 registered under Section 20, 22, 23 and 24 of the N.D.P.S. Act.

The learned counsel for the petitioner submits that petitioner is not the owner of Kirana shop. His brother Anirudh Giri @ Anirudh Bharti runs both the shops but it is evident from the contents of the FIR that both the brothers were running the Kirana shop and after seeing the police they fled away. On search from the shop of petitioner 125 gm. Ganja kept in different Pudiyas was recovered.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
