JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 43 of 2018 registered for the offences punishable under Sections 498A, 323, 379 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioner is of subjecting the opposite party No.2, wife to cruelty and ousting her from the house with respect to demand of Rs.2 lacs.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with dignity and care.

Heard learned APP and learned counsel for the informant.

No.18981 of 2019(2) dt.06-05-2019 2/2 In view of above facts and circumstances, let petitioner appear before the court below within four weeks from the receipt of this order and file a petition on affidavit that he is ready to keep opposite party No.2 with him with dignity and care and on filing of such petition, the petitioner shall be released on provisional bail for a period of nine months and in the meantime, learned court below shall issue notice to opposite party No.2 to appear in the court on a date fixed and petitioner be also directed to be present and thereafter watch the conduct of both the petitioner and opposite party No.2 by calling them in first week of every month in court and once the court is satisfied with their conduct, specially of the petitioner, his bail bond shall be confirmed, otherwise the court is free to pass any other order(s) as it may deem fit and proper.

With the above observation, this application is disposed of.
