JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offences punishable under Section 147, 148, 149, 341, 384, 504, 506 of the Indian Penal Code and section 138 of N.I. Act.
The accusation against the petitioners is that they demanding Rs. 10 lacs extortion money when the informant made attempt to get the house constructed on her land. Submission on behalf of the petitioners is that the land in question was purchased by full brother of petitioner no. 1 and as a matter of fact, the informant filed the present case to
Patna High Court Cr.Misc. No.67511 of 2018(2) dt.06-12-2018 2/2 put pressure upon the brother of petitioner no. 1, who has filed title suit against the informant and her husband which has specifically been pleaded at para-11 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah in Bettiah Muffasil P.S. Case No. 451 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
