The petitioner, who is in custody since 04.03.2020, seeks bail in connection with Kashichak P. S. Case No. 12 of 2020 dated 23.01.2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears that on secret information that liquor has been stored at a place, a raid was conducted near the Dalan of the petitioner. Four persons were spotted fleeing away on seeing the policy party. One Dilkhush Kumar, who was arrested, disclosed the name of the three other persons
Patna High Court CR. MISC. No.20613 of 2020(2) dt.23-06-2020 2/2 who fled away, which included the name of the petitioner. It has been submitted that from the Dalan, 147.375 litres of liquor is said to have been recovered. However, looking at the nature of accusation; taking into account the period of custody of the petitioner; and his being a person of clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Nawada in connection with Kashichak P. S. Case No. 12 of 2020. The petition stands allowed.
