The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366A and 34 of the Indian Penal Code and Section 8 and 18 of the POCSO Act. In pursuance to the order dated 22.06.2022, status report of trial in connection with Bettiah (Muffasil) (Banuchhapar O.P.) P.S. Case No. 124 of 2020 has been received and kept at Flag-X, in which it is reported that five witnesses have been examined and case is fixed for evidence of rest of the witnesses. As per list of the witnesses mentioned in the charge-sheet, two doctor and Investigating Officer have not been examined in this case till date. Summons against rest of the witnesses have been sent. It is further reported that this case may likely to be concluded within 3-4 months, if witnesses

Learned counsel for the petitioner submits that the petitioner is languishing in judicial custody since 27.08.2020 and he has no criminal antecedent as stated in para-3 of the bail application.

Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Bettiah Muffasil (Banuchhapar O.P.) P.S. Case No. 124 of 2020. Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of six months. Both parties are directed to cooperate in the trial.
