The petitioner prays for grant of bail in Chhatauni P.S. Case No. 132 of 2016 registered under diverse penal provisions of IPC, section 25(1-b) a, 26 of the Arms Act and section 47(A) of the Excise Act.

On the basis of the statement of the SHO of Chhatauni police station, the FIR was lodged in which it was alleged that one businessman from Nepal was kidnapped and on getting said information raids were conducted at different places wherein one Vimlendu Ranjan @ Ranjan Jha was arrested with certain firearms, besides bottles of wine and a vehicle. It is further alleged that he made a confessional statement naming the

It is submitted that besides the above, there is no other tangible material available against the petitioner in the present case. He is in custody since 06.06.2016. The petitioner carries criminal antecedents. The contention is that the said co-accused namely Vimlendu Ranjan @ Ranjan Jha having same criminal antecedents has been granted bail by this Court vide order dated 04.10.2016 passed in Cr. Misc. No. 43884. He has also few criminal cases to his credit. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Motihari in Chhatauni P.S. Case No. 132 of 2016 (GR 2524 of 2016) on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, he shall appear in person on each date fixed at the trial. Failure in appearance on two consecutive dates shall entail cancellation of his bail bonds.
