Petitioners are apprehending their arrest in Barh P.S. Case No.182/16 for the offence under Section 304/34 of the I.P.C. Accusation is that the petitioners used to irrigate their field by running damaged electric wire from transformer by fixing toka. On the day of occurrence while the father of informant was returning his house after grazing his cattle, in the way damaged and uncovered wire was lying on the earth due to rain current spread in the water in which Ram Pravesh Yadav father of informant sustained current injury and he died. Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.17288 of 2017 (4) dt.07-08-2017 2/2 case, and nature of allegation, I am not inclined to enlarge the petitioners on anticipatory bail. Prayer for anticipatory bail of the petitioners is rejected.

However, the petitioners are directed to surrender before the court below and pray for regular bail which shall be considered by the learned court below on its own merit without being prejudiced by this order.
