The petitioner is accused in connection with Bikramganj P.S. Case No. 135 of 2016 registered under sections 302/34 of the I.P.C. and 27 of the Arms Act pending in the Court of S.J.-1st-cum-A.C.J.M., Bikramganj (Rohtas). The allegation is of killing of the father of the informant by the accused persons.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is also submitted that petitioner is in custody since 16.07.2016.
Learned A.P.P. appearing on behalf of the State
Patna High Court Cr.Misc. No.50936 of 2016 (3) dt.19-01-2017 2/2 submits that there is direct allegation of assault on the face of father of the informant by means of country-made pistol against the petitioner. In paragraph nos. 4 and 5, witnesses have also supported the prosecution case.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
