JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Excise Case No. 915 of 2018, corresponding to P.R. No.26/2018-19 disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act 2016.

Allegation is of recovery of 6.660 liters liquor from near the house of the petitioners.

Submission of learned counsel for the petitioners is that the recovery is not from the conscious possession of the petitioners or from their house, rather from the road side and the petitioners have no criminal antecedents.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners,

Patna High Court CR. MISC. No.20155 of 2019(3) dt.07-05-2019 2/2 above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Vi- Cum-Special Judge (Excise) Kaimur (Bhabua), in connection with Excise Case No. 915 of 2018, corresponding to P.R. No.26/2018-19, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
