The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 384/34 of the Indian Penal Code.

As per prosecution case, the accused persons including the petitioner made a demand of extortion of Rs. 2 Lacs from the informant. It is further alleged that the accused persons forcibly installed three cement pillars by constructing the same on the land of informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted that the dispute regarding measurement of land in question was

Patna High Court CR. MISC. No.21948 of 2023(2) dt.22-05-2023 2/2 arose between the informant and co-accused Mrityunjay Yadav and as such, this petitioner has no concerned with the said land. There is no specific overt-act against the petitioner and ransom demand has also not been executed. It is further submitted that the petitioner is languishing in judicial custody since 22.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bihpur (Bhagwanipur O.P) P.S. Case No. 301 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Naugachhia.
