2. This is 3rd attempt for grant of bail. Lastly, the prayer for bail of petitioner was rejected, vide order dated 11.01.2023 passed in Cr.Misc. No.52142 of 2022.

3. Trial Court report reveals that the case is pending at the stage of prosecution evidence and till date, only one prosecution witness has been examined.

4. In this case, there is recovery of 174.585 liters of illicit liquor.

5. It is submitted on behalf of petitioner that after framing of charge, there is no adequate progress and petitioner is languishing in jail since 27.08.2021.

6. Learned A.P.P. for the State vehemently opposed the bail petition.

7. Considering the period of custody and tardy progress of trial, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise III, Saran at Chapra / concerned court in connection with Parsa P.S. Case No. 118 of 2019.
