The petitioner apprehends his arrest in connection with Arrah Nawada P.S. Case No. 487 of 2018 registered under Sections 406, 420, 467 and 438/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that this is a case of civil dispute. On perusal of Annexures, it appears that under mutual negotiation, the matter was settled and payment has been made in four installments by the petitioner. No objection certificate was issued by the Company itself and hypothecation was cleared. Further submission is that after clearance from the District Transport Office, the vehicle was sold by the petitioner without violating any provision of law. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Arrah in connection with Arrah Nawada P.S. Case No. 487 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
