This application for regular bail arises out of Baunsi P.S. Case No. 20 of 2008, disclosing offences punishable under Sections 399/402 of the Indian Penal Code.

The F.I.R. was registered in 2008. Allegedly, some of the persons named in the F.I.R. were apprehended by the police, when they were planning to commit dacoity. In course of enquiry, they are said to have disclosed the name of the petitioner as one of the conspirators.

Learned counsel appearing on behalf of the petitioner has submitted that similar other co-accused persons have been granted bail. He has further submitted that the petitioner is in

Patna High Court CR. MISC. No.19815 of 2020(2) dt.23-06-2020 2/2 custody since 06.03.2020. Except for the alleged disclosure of the co-accused in respect of the petitioner's involvement, there is no case against the petitioner, as stated in paragraph 3 of the application.

Considering the above submission, this application is allowed. Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-1, Banka in connection with Baunsi P.S. Case No. 20 of 2008.
