The Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code and subsequently Sections 376, 120(B) of I.P.C. was added.
As per the F.I.R., co-accused Karim Sai and his brother Firoj Sai @ Bhanu kidnapped the daughter of the informant. It is submitted that the petitioners have been made accused in this case merely because they happen to be relatives of co-accused. The alleged victim has not named the petitioners rather she has stated that co-accused, Karim Sai, has kidnapped her. Similarly situated accused persons have already been granted bail vide order dated
Patna High Court CR. MISC. No.23314 of 2023(2) dt.26-06-2023 2/2 20.02.2020 (passed in Cr. Misc. No.86253 of 2019), 18.11.2021 (passed in Cr. Misc. No.24450 of 2021)and 07.03.2022 (passed in Cr. Misc. No.25277 of 2021) respectively. Petitioners have clean antecedent, as stated in para 3 of the bail petition. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Bhonjpur at Ara, Patna, in connection with Ara Town P.S.
