JUSTICE SATYAVRAT VERMA ORAL ORDER 26-11-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Andhramath P.S. Case No. 22 of 2021 dated 28.02.2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.31201 of 2021(2) dt.26-11-2021 2/2 Learned counsel for the petitioners submits that the petitioners are in custody since 01.03.2021, charge-sheet has been submitted in the case and are persons with clean antecedent.

Learned counsel for the petitioners submits that allegation is of recovery of 188.1 litre of liquor with which the petitioners have no concern.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 01.03.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum Special Judge, Excise Act, Madhubani in connection with Andhramath P.S. Case No. 22 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
