====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-04-2024 Heard learned counsel for the petitioner and and Mr. Umeshanand Pandit, learned A.P.P. for the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 337, 338, 354B, 504, 506 of the Indian Penal Code and Section 67 of the Information Technology Act.

3. According to F.I.R., petitioner is alleged to have posted some obscene photograph of the informant on social media for which a panchayati was convened in which this petitioner pelted stones due to which some persons sustained injuries.

4. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. He next

Patna High Court CR. MISC. No.24742 of 2024(2) dt.24-04-2024 2/2 submits that name of the petitioner does not find place in the accused column and therefore, he was not remanded in the present case as on the same day a case was lodged by the Circle Officer vide Bahadurpur P. S. Case No. 310/21 for the same set of occurrence and the petitioner was sent to the judicial custody on 12.06.2021. Later, petitioner was granted regular bail on 18.12.2021.

Considering the fact that petitioner has already been to the judicial custody for the same set of occurrence, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Darbhanga in connection with Bahadurpur P. S. Case No. 309 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
