02. In the present case, the petitioner seeks bail in connection with Jehanabad P.S. Case No. 375 of 2024 registered for the alleged offences under Sections 394/411 of the Indian Penal Code.
03. As per prosecution case, three miscreants on gunpoint tried to snatch the motorcycle of the informant and assaulted him. When the informant and his associates opposed the act of the miscreants, they opened fire and thereafter, the miscreants fled away with the motorcycle of the informant. The name of the petitioner transpired during investigation for being involved in the said crime.
04. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.20274 of 2025(2) dt.23-04-2025 2/3 petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of the petitioner. The petitioner has not been put to any test identification parade. The petitioner's name came up in this case in confessional statement of co-accused Dilip Yadav, who has been granted bail vide order dated 09.01.2025 passed in Criminal Misc. No. 85447 of 2024 by a Co-ordinate Bench. Except for the confessional statement, there is no other material to connect the petitioner with the offences as alleged. Learned counsel further submits that the petitioner had been made accused in altogether four cases and in two such cases, he has been acquitted and in other two cases, he is on bail. The petitioner is in custody since 06.01.2025 and charge-sheet has been submitted.
05. Learned APP for the State opposes the prayer for bail.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that no recovery is stated to be made from the petitioner and further considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs.
Patna High Court CR. MISC. No.20274 of 2025(2) dt.23-04-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 375 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) If recovery of motorcylce was made from this petitioner or at his instance, the bail bond of the petitioner will not be accepted.
(ii) One of the bailors will be a close relative of the petitioner.
(iii) The petitioner will remain present on each and every date fixed by the court below.
(iv) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
