JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-b)a/26 of the Arms Act.

Petitioner is in jail custody since 13-03-2016 on the accusation that one loaded country-made pistol and one cartridge were recovered from his conscious possession. Petitioner was earlier made accused in some cases but submission on behalf of petitioner is that the police implicated the petitioner in this false case and as a matter of fact, nothing had been recovered from his conscious possession.

Considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.37399 of 2016 (2) dt.08-09-2016 2/2 of the case as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dalsingh Sarai P.S. Case No. 103 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai.
