2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner seeks bail in connection with Shahpur (Karnamepur) P.S. Case No. 65/2023 registered for the offence punishable under Sections 304(b)/201 of the Indian Penal Code.

4. Learned counsel for the petitioner submits that though the allegation against the petitioner is of killing the deceased, but the petitioner has not killed the deceased. He further submits that the deceased was making allegations against the petitioner of having illicit relation with his Bhabhi and she committed suicide and the deadbody was disposed of.

5. He further submits that the deceased and the petitioner were blessed with a daughter who is 2 1⁄2 years old and is staying with the family of the petitioner.

6. The petitioner is in jail since 27.04.2023 and he has clean antecedent.

7. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Bhojpur at Ara concerned court in connection with Shahpur (Karnamepur) P.S. Case No. 65/2023, subject to the condition that befeor the releasing the petitioner on bail, the Court below will verify the fact of the daughter of staying with the family of the petitioner.

8. The petitioner will co-operate in the trial and will appear regularly either personally or through his Advocate.

9. The photostat copy of the supplementary affidavit is taken on record.
