Deceased along with informant i.e. husband and wife while were at their field, it has been alleged by the informant that first shot was given by Mithilesh Yadav, then by Arun Kumar Singh, then by Raju Rai and then by Randhir Yadav over her husband, who died instantaneously. During said course, it has been alleged that petitioner, Purushottam Kumar had fired upon her having narrow escape. Petitioner, Rahul Yadav had fired in air. Hareram Yadav and Munna Yadav have threatened her. Nothing had prevented against any of the petitioners to have repeatedly shot at informant or deceased and in the aforesaid background, presence of petitioners as stated became

Patna High Court Cr.Misc. No.39934 of 2016 (02) dt.17-09-2016 doubtful. Moreover, petitioners are under custody since 01.08.2016.

Considering the same, petitioners, Purushottam Kumar @ Tutu @ Tuk Tuk Kumar and Rahul Yadav are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Supaul in connection with Jadia P. S. Case no.155 of 2014.
