JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 146/2018, registered for the offence punishable under Sections 341, 323, 498 (A), 201, 304 (B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case as alleged in the F.I.R. There is no eye witness of this occurrence. Petitioner has no criminal antecedent. Petitioner is in custody since 24.12.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.23455 of 2023(2) dt.22-05-2023 2/2 the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 146/2018.
