2. The petitioner apprehends his arrest in connection with Raxaul P.S. Case No. 483 of 2021 registered under Section 379 of the Indian Penal Code.
3. It is alleged that co-accused Ayush Kumar committed theft of motorcycle of the informant and when he was apprehended he disclosed the name of the petitioner.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on the confessional statement of co-accused Ayush Kumar. Further submission is that petitioner was neither arrested at the spot nor any incriminating article has been recovered from the conscious
Patna High Court CR. MISC. No.24908 of 2024(2) dt.08-05-2024 2/2 possession of the petitioner. The petitioner has got no criminal antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Raxaul P.S. Case No. 483 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
