Petitioner, who is in custody, seeks bail in connection with Phulparas P.S. Case No. 132 of 2018 (G.R.No. 892 of 2018) registered for the offences punishable under Sections 147, 148, 149, 323, 341, 504, 506 and 307 of the Indian Penal Code and under Section 27 of the Arms Act. Informant has alleged that after making purchase of household articles he was returning to his house when at about 7:10 P.M. eleven FIR named accused variously armed surrounded him and started abusing and assaulting him and also made indiscriminate firing upon him. There is specific allegation against Sunil Yadav of causing firearm injury when

Patna High Court Cr.Misc. No.68860 of 2018(2) dt.03-12-2018 2/2 he was fleeing away which hit below his left eye. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to dirty village politics. There is no specific allegation against petitioner of any overt Act. Allegation is that he was present along with other co-accused. Petitioner is also accused in Phulparas P.S. Case No. 100 of 2018. He is in custody since 11.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IInd, Jhanjharpur (Madhubani) in connection with Phulparas P.S.
