This application is filed for grant of regular bail in connection with Session Case No.403/2022 arising out of Khagaria Muffasil P.S. Case No. 519 of 2022 registered under section 468(A), 498(B), 306 of the Indian Penal Code. Learned counsel for the petitioner submits that one Sapna Kumari alleged that on 03.06.2022 she herself poured kerosene oil on her body and ablazed to fire due to continuous torture of her husband in drunken state. She has further alleged that after her death her children shall be looked after by her

The deceased committed suicide because of the beatings of the petitioner who is a drunkard. Considering the period of custody and considering the fact that the offence case under 306 is made out from the statement of the deceased, this application is allowed.

Learned A.P.P. has vehemently opposed the prayer for bail.

Let the petitioner, above named, be released on bail after framing of charge and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge Vth, Khagaria in connection with Session Case No.403/2022 arising out of Khagaria Muffasil P.S. Case No. 519 of 2022. The petitioner is directed to cooperate in the trial. It he does not cooperate in the trial, the Court below is at liberty to cancel the bail bonds of the petitioner.
