JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 307, 379, 352, 448, 354, 504, 506, 509 of the Indian Penal Code.

The prosecution case is that all the accused persons came variously armed when petitioner No. 1 assaulted with Hasuli on the head of the informant causing bleeding injury and petitioner No. 2 assaulted with dagger to the informant. Co-accused Badal Kumar assaulted with iron rod to Basudeo Singh and when Dina Devi, Babita Devi and Anita Devi came to rescue then they were also assaulted. It is alleged that petitioner No. 2 torn cloths of the sister-in-law of the informant.

It is submitted by learned counsel for the petitioners that in the background of land dispute, the

Patna High Court Cr.Misc. No.41858 of 2015 (3) dt.02-11-2015 2/2 accusation has been levelled and there is counter version of the occurrence also.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Hajipur Town P.S. Case No. 470 of 2015, pending in the Court of learned Chief Judicial Magistrate, Vaishali at Hajipur. With the observations above, the application stands disposed off.
