The petitioners have preferred this application for grant of regular bail in a case registered under sections 302, 201 and 120B of the Indian Penal Code.

As per the prosecution case, it is stated that as a result of differences and dispute between her son Rajendra Singh and daughter-in-law, the five named accused persons including the three petitioners came and took away the informant's son stating that he would get the matter settled. Subsequently, information was received that her son had been killed and on going near the place of occurrence, she found the dead body of her son. The informant states that she is convinced

It is submitted by learned senior counsel appearing for the petitioners that the petitioners have been falsely implicated in the case. Only an unsubstantiated suspicion has been raised by the informant because of their relationship being brothers of the wife of the deceased. At best the case against the petitioners is of last seen. The petitioner nos.1 and 3 are in custody since 4.7.2020 and the petitioner no.2 is in custody since 11.9.2020. They have no criminal antecedent and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the material on record and the petitioners having remained in custody for over 1 year, the Court directs the three petitioners to be enlarged on bail in connection with Nasariganj (Rohtas) P.S. Case no.96 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Bikramganj (Rohtas).
