JUSTICE JYOTI SARAN ORAL ORDER 07-01-2015 It is stated by Mr. S.B.K. Manglam that although the writ petition bearing CWJC No. 20217 of 2013 was allowed and the petitioner was restored to the post of Pramukh but since thereafter she has not been permitted to discharge her duties. This Court fails to appreciate as to how any action of the authorities of the Panchayat Samiti in not allowing the petitioner to discharge her duties can be a subject matter of contempt in the light of the directions passed in CWJC No. 20217 of 2013 which merely restores the position of the petitioner as Pramukh. If at all the petitioner is aggrieved by any action of the authorities of the
Patna High Court MJC No.4545 of 2014 (2) dt.07-01-2015 Panchayat Samiti in not allowing her to discharge her functions, the remedy for the petitioner lies elsewhere and not by way of a contempt application.
This application is accordingly disposed of.
