Petitioner seeks bail in a case registered under section 394 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, one witness claimed to have been seen the petitioner standing near the place of occurrence prior to the alleged occurrence. Subsequently, witnesses stated that it was the petitioner who along with his associates committed the present crime. The Investigating officer, after receiving the information, chased the petitioner and some others but associates of the petitioner managed to flee away leaving behind motorcycle whereas petitioner was arrested. Seized motorcycle does not relate to the present case. Considering this aspect of matter that the petitioner is in jail custody since 3.8.2016 and does not have any criminal antecedent, let
