ANJANA MISHRA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 7 of the E.C. Act.
Learned counsel for the petitioner submits that the petitioner has been a PDS dealer since the year 1993 and has been conducting his business with all honour and integrity and till date there has been no complaint against him. He submits that though there is an allegation against the petitioner that he illegally sold the allotment of May, 2014 but all food-grains which were received by him, have been found to be kept intact in his shop. He further submits that on account of the said allegations the petitioner's lincence has been cancelled.
Patna High Court Cr.Misc. No.12891 of 2015 (3) dt.31-08-2015 P2/2 Learned counsel for the petitioner submits that other similarly situated PDS dealers have been extended the benefit of anticipatory bail by a bench of this Court passed in Cr. Misc. No. 12720 of 2015 vide order dated 27.03.2015.
Considering the aforementioned fact and also the order dated 27.03.2015, let the petitioner abovenamed, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gopalganj in connection with Vijaipur P.S. Case No.130 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
