JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Counsel for the petitioner seeks and is permitted to make necessary correction in the original petition in course of the day.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-392 of the Indian Penal Code.

Petitioner is not named in the first information report and it appears that the name of petitioner came in this case in course of investigation.

Learned counsel for the petitioner submits that as a matter of fact, the petitioner and one co-accused were arrested in a case of Arms Act and police got recorded the confessional statement of co-accused as well as the petitioner. It is further

No.45957 of 2016 (2) dt.21-10-2016 2/2 submitted that on the basis of confessional statement of coaccused Rajesh Kumar, some looted money is said to have been recovered but so far as the petitioner is concerned; except the confessional statements, there is nothing against him. The petitioner is languishing in jail custody since 0402-2016 and uptill now, he has not been put on Test Identification Parade.

No doubt, prior to institution of the present case, the petitioner was made accused in two cases but considering the above-said facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Naokothi P.S. Case No. 08 of 2016 to the satisfaction of Sri Amit Anand, learned Judicial Magistrate-Ist Class, Begusarai.
