Binod Bihari Sinha, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: The writ petition stands disposed off in the following agreed terms. The State authorities agree that all admissible dues in accordance with law shall be paid to the petitioner within two months. For such purpose, the petitioner shall be at liberty to appear before the authorized officer of the Department with regard to coming to a finding/figure relating to the admissibility of the petitioner in accordance with law. It has been also agreed that the concerned State authority shall also issue sanction order and forward it to the Accountant General with regard to pension and gratuity.
It has been agreed on behalf of the Accountant General that upon receipt of the sanction order, necessary authority shall be issued within two weeks from the receipt of the sanction order. The State authorities agree that necessary payment of the admissible dues in accordance with law to the petitioner shall be made within two months thereafter.
The petitioner shall be at liberty, if according to him anything further remains to be paid, to move before the appropriate forum in accordance with law.
The parties are informed that the court fee, if any, paid by any of them shall be refunded.
