Petitioner is a Ward Member who apprehending arrest in connection with Kesariya P.S.Case No. 157 of 2018 for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. He further submits that the allegation against this petitioner is of assaulting the informant Nand Kishore and during course of investigation Nand Kishore was not examined. He further submits that other co-accused have been granted anticipatory

Patna High Court CR. MISC. No.25938 of 2020(2) dt.05-11-2020 2/2 bail vide Annexure-2 of this petition. He further submits that on account of dispute regarding implementation of Nal Jal Yojna, there is case and counter case between the parties. Considering the fact that the petitioner is a Ward Member and he was responsible for the implementation of Nal Jal Yojna and also the fact that other co-accused have been granted anticipatory by a coordinate Bench of this Court, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner named above, be released on bail in the event of arrest or surrender before the court below within a period of one month from the date of communication of a copy of this order on furnishing bail bond of Rs.50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Kesariya P.S.Case No.157 of 2018, subject to the condition as laid down under section 438(2) of the Cr.P.C.
