JUSTICE SHIVAJI PANDEY ORAL ORDER 18-08-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with Mahila P.S. Case No. 45 of 2019 registered for offence punishable under section 376 of the Indian Penal Code. As per the record, the age of the petitioner is 22 years and the age of the victim lady is 40 years.

Allegation has been made to have committed rape upon the victim.

Learned counsel for the petitioner submits that the victim is an adult lady having major sons and daughters as also her two daughters are already married, in such circumstances, the allegation of commission of rape upon her appears to be an absurd.

No.20086 of 2020(3) dt.18-08-2020 2/2 Looking to the entirety of the fact, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Mahila P.S. Case No. 45 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
