====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Bhawanipur P.S. Case No. 10 of 2020, registered for the offence punishable under Sections 147, 148, 149, 447, 452, 341, 342, 323, 324, 302 and 120(B) of the Indian Penal Code, pending in the Court of learned Chief Judicial Magistrate, Purnea. Considering the allegation made in the F.I.R. that petitioner along with other co-accused named in the F.I.R. killed the mother of the informant. There is specific allegation against the petitioner that he has assaulted the victim by knife, which is corroborated with the Postmortem report, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the prayer for grant of regular bail is rejected.
Patna High Court CR. MISC. No.31450 of 2021(4) dt.24-02-2022 2/2 However, the learned trial Court is directed to conclude the trial expeditiously, well within a period of twelve months. If no substantial progress takes place in trial, the petitioner, if so advised, may renew his prayer for bail after twelve month.
