Learned counsel for the State and Mr. Mukesh Kumar learned counsel for the State Election Authority appear to inform that the complaint made by the petitioner rests on an order passed by this Court in the case of Ajay Kumar Vs. State of Bihar & Ors. arising from C.W.J.C.No.16554 of 2014. It is submitted that although the petitioner complains of illegal deletion of his name from the voter list prepared for the election held in the year 2014 which could not take place due to absence of quorum and though the petitioner also complains that even in the subsequent voter list
Patna High Court MJC No.2359 of 2015 (2) dt.02-03-2016 2/2 his name was not entered but the prayer for inclusion was not made before the appropriate authority. It is further submitted that the election is over and the petitioner not having taken recourse to the statutory remedy provided, no case for contempt is made out.
