In this case, the petitioners are apprehending their arrest in connection with Dumraon P.S. Case No. 305 of 2018 registered for offences under sections 341, 323, 324, 307, 504, 506 and 379/34 of the Indian Penal Code.
There is a case and counter case from both sides. The dispute arose on account of possession of the land. Specific allegation of causing injury by Farsa on the frontal part of the skull has been made upon Santosh Chand. With respect to Chun Mun Chand, the allegation has been attributed of causing injury by cricket wicket in the right index finger of the victim.
Patna High Court CR. MISC. No.23886 of 2019(2) dt.16-04-2019 2/2 Learned counsel for the petitioners submits that the alleged incident has taken place on 15.7.2018 but, the F.I.R. has been registered on 22.7.2018 and, that too, there is no explanation for such delay.
Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 305 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
