Petitioner seeks regular bail in connection with Sidhwalia P.S. Case No.140 of 2020 registered for the offence under Section 341, 328, 504, 506 , 498 (A) / 34 of the I.P.C. and Section 3⁄4 of the Dowry Prohibition Act.

The prosecution story in brief is that marriage of the informant was solemnized with the petitioner and after marriage petitioner and other family members started demanding a sum of Rs. 2 Lakh and a golden chain as dowry and due to non fulfillment of the demand, the petitioner and other accused persons tortured the informant physically and mentally and have also ousted the informant from her matrimonial home.

No.31452 of 2021(2) dt.13-12-2021 2/2 Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. He next submits that the petitioner is ready to keep his wife (i.e. informant) with full honour and dignity and he is in custody since 31.01.2021 and charge sheet has already been submitted. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 31.01.2021, allegation is general and omnibus in nature against the petitioner and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss Shobhna Tripathi J.M. 1st Class, Gopalganj in connection with Sidhwalia P.S.
